Public exhibition open
A draft Further Amendment to a Planning Agreement between Central Coast Council and Wathara NSW Pty Limited is on public exhibition.
A planning agreement is a legal agreement that sets out public benefits a developer will provide as part of a proposed planning and development process. The agreement relates to land at 985–991 The Entrance Road and 139 Bakali Road, Forresters Beach.
What does the Planning Agreement do?
Under the draft agreement, the developer would provide community benefits (called Development Contributions) including:
- Open space land to be dedicated to Council as a public reserve (local open space).
- Road intersection works associated with the Central Coast Highway / Forresters Beach Road intersection (in coordination with Transport for NSW processes).
- Environmental conservation works for land to be zoned C2 Environmental Conservation, managed through a Vegetation Management Plan.
What amendments have been made?
Further proposed amendments relate to the open space park and playground construction and details of work to be undertaken by the Developer, rather than Council.
Further Voluntary Planning Agreement amendments are now being sought to affect the court approved Vegetation Management Plan and includes provisions related to the calculation and management of a bond for the carrying out of the conservation work, specifically:

Public Exhibition November 2025
Council previously sought feedback on the draft Amendment to the Planning Agreement between Central Coast Council and Wathara NSW Pty Ltd relating to land fronting The Entrance Road and Bakali Road at Forresters Beach.
The original Planning Agreement was associated with the original rezoning of the site in 2022 for 137-145 Bakali Road and 925-993 The Entrance Road (Central Coast Highway), Forresters Beach.
The proposed amendment relates to the open space park and playground construction and details of work to be undertaken by the Developer, rather than Council. The details of the park and playground are set out in the Amended Planning Agreement.
The proposed amendments to the Planning Agreement are:
- Reduction in the area of land to be dedicated to Council (from 4000m2 to 3636m2)
- Insertion of Clause 3.5 to read – This agreement does not apply to any obligation that the Proponent may have to pay contributions, fees or charges under section 7.24 of the Act, the Water Management Act 2000 or the Local Government Act in respect to the development of the land.
- Additional definitions added under clause 4.
- Update Schedule 2, to include clause 2.1(a) for the Developer’s obligation and 2.1(b) for Council’s obligation.
- Update of Schedule 2 to include embellishment of the land by the Developer to provide a local play space and improvements as included in the Park Concept Plan, with the details illustrated in Schedule 6.
